सामान्य नागरिकले आपसमा कुरा गर्ने, कारोबार गर्ने र आफ्ना विचार अभिव्यक्त गर्ने स्वतन्त्रता निर्वाध हुनुपर्छ । यो अधिकार जुनसुकै माध्यममार्फत प्रयोग गर्न सकिने हुनुपर्छ । संविधानले स्पष्ट तोकेका अपवाद बाहेक कुनै पनि बहानामा सञ्चार वा कारोबारमा अवरोध सिर्जना गर्न मिल्दैन ।
आजको समयमा इन्टरनेटमा आधारित सञ्चार र कारोबार नेपाली समाजका अपरिहार्य धमनी बनेका छन् । यी विना समाज चल्नै सक्दैन । नेपालमा सञ्चारका आधुनिक माध्यम सुरुदेखि नै राज्यको नियन्त्रणमा रहे (जस्तै– गोरखापत्र)। निजी सञ्चारमाध्यमहरू पनि सुरुदेखि नै सीमित संगठित समूह र कुलीनहरूको नियन्त्रणमा रहेका छन्, जुन अन्य धेरै देशहरूमा देखिने स्थिति भन्दा फरक छैन ।
इन्टरनेटले सञ्चारमाध्यममाथिको राज्य र निजी व्यवसायीहरूको द्विअधिकार तोडिदिएको छ । इन्टरनेटमा आधारित सञ्चारका कारण अब सामान्य नागरिकले समेत आफ्नो आवाज सजिलैसँग आफ्ना साथी र आफन्तमाझ मात्र होइन, टाढासम्म समेत् पुर्याउन सक्छन् । नेपाली नागरिकले इतिहासमै पहिलोपटक पाएको यो शक्तिशाली इन्टरनेट अभिव्यक्तिको अधिकार कुनै पनि बाहानामा हरण गर्न पाइँदैन ।
People should be free to speak with one another, conduct transactions, and express themselves without restriction. They should have the right to do so through any medium they choose. Apart from the limitations clearly set out in the Constitution, no pretext should be used to obstruct communication or commerce by any means.
Today, internet-based communication and transactions are the lifeblood of Nepali society. Without them, society cannot function. From the very beginning, however, the state has kept a tight grip on modern communication channels (for example, Gorkhapatra). Private media, too, have long remained in the hands of a small circle of organised elites, a situation not very different from other parts of the world.
The internet has disrupted this duopoly of state and private control over the media. Thanks to digital networks, even an ordinary citizen with no power or influence can project their voice across their circles of friends and family, and far beyond. This represents the most powerful right of expression ever gained in Nepal’s history, and it must not be undermined under any excuse.
